NFI Position:    
                   

1. Gaming and gambling are different;
    

2. In the Dodd-Frank Act, though, by "gaming," Congress actually meant gambling;
    

3. The CFTC has review authority for event contracts that are based on any contingent event; and 
    

4. The Economic Purpose Test, while repealed, should still be the guiding principle.
